AGENCY: Federal Communications Commission.
ACTION: Proposed rule.

SUMMARY: The Commission requests comments on a petition filed by Thomas
Desmond proposing the allotment of DTV channel 51 to Medical Lake,
Washington, as the community's first local commercial television
service. DTV Channel 51 can be allotted to Medical Lake, Washington, at
reference coordinates 47-34-12 N. and 117-41-32 W. Since the community
of Medical Lake is located within 400 kilometers of the U.S.-Canadian
border, concurrence from the Canadian government must be obtained for
this allotment.
DATES: Comments must be filed on or before September 9, 2004, and reply
comments on or before September 24, 2004.

sent to 9300 East Hampton Drive, Capitol Heights, MD 20743. U.S. Postal
Service first-class mail, Express Mail, and Priority Mail should be
addressed to 445 12th Street, SW., Washington, DC 20554. All filings
must be addressed to the Commission's Secretary, Office of the
Secretary, Federal Communications Commission, Washington, DC 20554. In
addition to filing comments with the FCC, interested parties should
serve the petitioner, or its counsel or consultant, as follows: Thomas

Provisions of the Regulatory Flexibility Act of 1980 do not apply
to this proceeding.
