ENVIRONMENTAL PROTECTION AGENCY
40 CFR Part 52
[FL-91-200323 (b); FRL-7621-9]
Approval and Promulgation of Implementation Plans Florida:
Southeast Florida Area Maintenance Plan Update
AGENCY: Environmental Protection Agency (EPA)
ACTION: Proposed rule.
-----------------------------------------------------------------------
SUMMARY: The EPA is proposing to approve revisions to the State
Implementation Plan (SIP) submitted by the Florida Department of
Environmental Protection on December 20, 2002. This SIP revision
satisfies the requirement of the Clean Air Act for the second 10-year
update for the Southeast Florida area (Dade, Broward, and Palm Beach
Counties) 1-hour ozone maintenance plan. In the Final Rules section of
this Federal Register, the EPA is approving the State's SIP revision as
a direct final rule without prior proposal because the Agency views
this as a noncontroversial submittal and anticipates no adverse
comments. A detailed rationale for the approval is set forth in the
direct final rule. If no significant, material, and adverse comments
are received in response to this rule, no further activity is
contemplated. If EPA receives adverse comments, the direct final rule
will be withdrawn and all public comments received will be addressed in
a subsequent final rule based on this rule. The EPA will not institute
a second comment period on this document. Any parties interested in
commenting on this document should do so at this time.
DATES: Written comments must be received on or before March 15, 2004.
