ACTION: Proposed rule.

SUMMARY: This document requests comments on a petition for rulemaking 
filed by Columbus Community Radio Corporation, licensee of Station 
WHUM-LP, Channel 253L1, Columbus, Indiana, requesting allotment of 
Channel 228A at Columbus, Indiana, and its reservation for 
noncommercial educational use. Channel 228A can be allotted and 
reserved for NCE use in compliance with the Commission's minimum 
distance separation requirements, with the imposition of a site 
restriction of 7.9 kilometers (4.9 miles) southeast at reference 
coordinates 39-09-06 NL and 85-52-09 WL.

DATES: Comments must be filed on or before September 19, 2005, and 
reply comments on or before October 4, 2005.

to this proceeding.
    Members of the public should note that from the time a Notice of 
Proposed Rule Making is issued until the matter is no longer subject to 
Commission consideration or court review, all ex parte contacts are 
prohibited in Commission proceedings, such as this one, which involve 
channel allotments. See 47 CFR 1.1204(b) for rules governing
