Approval and Promulgation of State Air Quality Plans for
Designated Facilities and Pollutants; Maryland; Control of Emissions
From Commercial and Industrial Solid Waste Incineration (CISWI) Units
AGENCY: Environmental Protection Agency (EPA).
ACTION: Proposed rule.

SUMMARY: EPA is proposing to approve the May 12, 2005 negative
declaration letter submitted by the Maryland Department of the
Environment (MDE). The negative declaration certifies that existing
CISWI units, subject to Clean Air Act (the Act) requirements of
sections 111(d) and 129 and the related emissions guidelines (EG), have
been permanently shut down and have been dismantled in the State of
Maryland.
In the Final Rules section of this Federal Register, EPA is
approving the MDE certification as a direct final rule without prior
proposal because the Agency views this as a noncontroversial action and
anticipates no adverse comments. If no adverse comments are received in
response to this action, no further activity is contemplated. If EPA

receives adverse comments, the direct final rule will be withdrawn and
all public comments received will be addressed in a subsequent final
rule based on this proposed rule. EPA will not institute a second
comment period. Any parties interested in commenting on this action
should do so at this time.
