Notice of Public Information Collection(s) Being Reviewed by the
Federal Communications Commission, Comments Requested
November 28, 2005.
SUMMARY: The Federal Communications Commission, as part of its
continuing effort to reduce paperwork burden invites the general public
and other Federal agencies to take this opportunity to comment on the
following information collection(s), as required by the Paperwork
Reduction Act (PRA) of 1995, Public Law 104-13. An agency may not
conduct or sponsor a collection of information unless it displays a
currently valid control number. No person shall be subject to any
penalty for failing to comply with a collection of information subject
to the Paperwork Reduction Act that does not display a valid control
number. Comments are requested concerning (a) whether the proposed
collection of information is necessary for the proper performance of
the functions of the Commission, including whether the information
shall have practical utility; (b) the accuracy of the Commission's
burden estimate; (c) ways to enhance the quality, utility, and clarity
of the information collected; and (d) ways to minimize the burden of
the collection of information on the respondents, including the use of
automated collection techniques or other forms of information
technology.
DATES: Written Paperwork Reduction Act (PRA) comments should be
submitted on or before February 13, 2006. If you anticipate that you
will be submitting comments, but find it difficult to do so within the
period of time allowed by this notice, you should advise the contact

Title: Amendment of the Commission's Rules Regarding the 37.0-38.6
GHz and 38.6-40.0 GHz Bands, Third Notice of Proposed Rulemaking.
Form No.: N/A.
Type of Review: Extension of a currently approved collection.
Respondents: Business or other for-profit, not-for-profit
institutions, and state, local, or tribal government.
Number of Respondents: 700 (approximately 4 applicants for each of
the 175 license areas).
Estimated Time Per Response: 300 hours per auction bidder.
Frequency of Response: Every 10 year reporting requirement.
Total Annual Burden: 2,100 hours.
Total Annual Cost: $315,000.
Privacy Act Impact Assessment: N/A.
Needs and Uses: The Commission proposes to issue geographic area
licenses for the 37.0-38.6 GHz band, or in the alternative, seeks
comment on the possibility of using a first-come, first-served link-by-
link registration approach comparable to the 70/80/90 GHz Report and
Order. In that proceeding, the Commission decided to issue non-
exclusive nationwide licenses conditioned upon site and path-specific
coordination wherein many service providers would engineer their
systems to operate in close proximity, without causing mutual
interference. In order to facilitate such coordination, the Commission
adopted non-interference requirements and required all licensees to
register their facilities in a database accessible to other licensees
on a first-come, first-served basis. Although the Commission determined
not to impose a limit to the number of non-exclusive nationwide
licenses, licensees would be required to construct individual links
within 12 months after registering them. Our goal is to establish a
flexible regulatory framework that would promote seamless deployment of
a host of services and technologies in the 73 GHz and 42 GHz bands. We
seek to enhance opportunities for deployment of broadband wireless
services, foster effective competition, promote innovation and further
our efforts for consistent rule application regarding broadband
wireless services.
