Proposed Settlement Agreement, Clean Air Act Citizen Suit
AGENCY: Environmental Protection Agency (EPA).
ACTION: Notice of Proposed Settlement Agreement; Request for Public
Comment.

SUMMARY: In accordance with section 113(g) of the Clean Air Act, as
amended (``Act''), 42 U.S.C. 7413(g), notice is hereby given of a
proposed settlement agreement, to address a petition for review filed
by the American Foundry Society in the United States Court of Appeals
for the District of Columbia Circuit: American Foundry Society v. EPA,
No. 04-1191 (D.C. Cir.). On June 18, 2004, Petitioner filed a petition
for review challenging the EPA's final rule entitled ``National
Emission Standards for Hazardous Air Pollutants for Iron and Steel
Foundries'' published at 69 FR 21,906 (April 22, 2004). Under the terms
of the proposed settlement agreement, EPA would sign a notice proposing
revisions to the rule that were the same in substance as set forth in
the attachment to the settlement agreement.

SUPPLEMENTARY INFORMATION:
I. Additional Information About the Proposed Settlement Agreement
Petitioners raised issues concerning the final rule entitled
``National Emission Standards for Hazardous Air Pollutants for Iron and
Steel Foundries'' published at 69 FR 21,906 (April 22, 2004) (``the
Rule'').
The proposed settlement agreement provides that no later than 30
days after it became final, EPA would sign a notice proposing revisions
to the Rule that were the same in substance as set forth in Attachment
A to the settlement agreement. The proposed revisions would add an
alternative compliance option for cupolas at existing foundries and
would include a number of small changes and clarifications. The Parties
would file a joint stipulation of dismissal of case number 04-1191 if
EPA promulgated final revisions that were materially the same as the
proposed revisions.
For a period of thirty (30) days following the date of publication
of this notice, the Agency will receive written comments relating to
the proposed settlement agreement from persons who were not named as
parties or intervenors to the litigation in question. EPA or the
Department of Justice may withdraw or withhold consent to the proposed
settlement agreement if the comments disclose facts or considerations
that indicate that such consent is inappropriate, improper, inadequate,
or inconsistent with the requirements of the Act. Unless EPA or the
Department of Justice determines, based on any comment which may be
submitted, that consent to the settlement agreement should be
withdrawn, the terms of the agreement will be affirmed.

Agreement

comments.
