Sec. 1274.401  Government property.


    The accomplishment of a cooperative agreement may require the 
purchase of equipment for a wide range of purposes. If this equipment is 
purchased with Government funds, i.e., as part of the Government 
contribution to the cooperative agreement, it becomes Government 
property and must be disposed of in accordance with 48 CFR (FAR) part 45 
at the conclusion of the cooperative agreement. In some cases, this may 
meet the needs of the parties. If, however, the recipient may need the 
equipment to continue commercial efforts following the cooperative 
agreement, it should be purchased by the recipient and included as a 
non-cash contribution of the recipient. In this way, it is not procured, 
not even in part, with Government funds and the Government acquires no 
ownership interest. Procurement by the recipient may be before or during 
the performance of the cooperative agreement.
