(a) Direct Hires. The head of each agency is delegated authority for adjudicating suitability under this part for applicants filing directly with the agency outside a civil service register. (b) OPM may in its discretion delegate to the heads of agencies authority for adjudicating suitability in other cases involving applicants and eligibles for, and appointees to, competitive service positions in the agency. (c) Paragraphs (a) and (b) of this section notwithstanding, OPM may exercise its jurisdiction under this part in any case when deemed necessary. (d) Any applicant, eligible, or appointee who is found unsuitable by any agency having delegated authority from OPM under this part for any reason named in Sec. 731.202 may appeal to the Merit Systems Protection Board under the Board's regulations.
