Sec. 739.36  Delivery of beans from storage.

    Except as may be provided by law or the regulations in this part, 
each warehouseman, (a) upon proper presentation of a receipt for any 
beans, other than bulk beans specially binned, and upon payment or 
tender of all advances and legal charges, shall deliver to such 
depositor or lawful holder of such receipt beans of the grade and 
quantity specified in such receipt, after making due allowance for such 
shrinkage as the receipt stipulates, or (b) upon proper presentation of 
a receipt for any beans the identity of which was to have been preserved 
during the storage period, and upon payment or tender of all advances 
and legal charges, shall deliver to the person lawfully entitled thereto 
the identical beans stored in his warehouse.
