Sec. 740.39  Delivery of nuts.

    Except as may be provided by law or the regulations in this part, 
each licensed warehouseman: (a) Upon proper presentation of a receipt 
for any nuts, other than identity-preserved nuts, and upon payment or 
tender of all advances and legal charges, shall deliver to such 
depositor or lawful holder of such receipt nuts of the grade or other 
class and quantity specified in such receipt, and (b) upon proper 
presentation of a

receipt for any nuts, the identity of which was to have been preserved 
during the storage period, and upon payment or tender of all advances 
and legal charges, shall deliver to the person lawfully entitled 
thereto, the identical nuts stored in his licensed warehouse.
