Sec. 100.16  Independent expenditure (2 U.S.C. 431(17)).

    The term independent expenditure means an expenditure by a person 
for a communication expressly advocating the election or defeat of a 
clearly identified candidate that is not made with the cooperation of or 
in consultation with, or in concert with, or at the request or 
suggestion of, a candidate or any agent or authorized committee of such 
candidate. A communication is ``made with the cooperation of, or in 
consultation with, or in concert with, or at the request or suggestion 
of, a candidate or any agent or authorized committee of such candidate'' 
if it is a coordinated general public political communication under 11 
CFR 100.23. See 11 CFR 109.1.
