Sec. 650.71  Waivers.

    (a) No action which is contrary to the provisions contained in this 
subpart will be taken without first obtaining a waiver of the 
requirement from HQDA (DAEN-ZCE) WASH DC 20310.
    (b) Waivers may be granted only if the President or the 
Administrator of EPA finds that the technology to implement such 
standards is not available or operation of the facilities in question is 
required for reasons of national security. Requests for such waivers 
will not be considered by HQDA unless it can be clearly and conclusively 
demonstrated that operation of the facilities in question and the 
proposed construction or modification meets the above criteria. Requests 
for waivers will be forwarded through command channels to HQDA (DAEN-
ZCE) WASH DC 20310.
