(a) Before submitting to the Secretary its application under this part, and before adopting a new or revised policy that is not in its current application, a State shall-- (1) Publish the application or policy in a manner that will ensure circulation throughout the State for at least a 60-day period, with an opportunity for comment on the application or policy for at least 30 days during that period; [[Page 187]] (2) Hold public hearings on the application or policy during the 60- day period required in paragraph (a)(1) of this section; and (3) Provide adequate notice of the hearings required in paragraph (a)(2) of this section at least 30 days before the dates that the hearings are conducted. (b) A State may request the Secretary to waive compliance with the timelines in paragraph (a) of this section. The Secretary grants the request if the State demonstrates that-- (1) There are circumstances that would warrant such an exception; and (2) The timelines that will be followed provide an adequate opportunity for public participation and comment.
