(a) The Site Evaluation List (SEL) was established as a comprehensive list of marine sites with high natural resource values and with historical qualities of special national significance that are highly qualified for further evaluation for possible designation as National Marine Sanctuaries. (b) The SEL is currently inactive. Criteria for inclusion of marine sites on a revised SEL will be issued, with public notice and opportunity to comment, when the Director determines that the SEL should be reactivated. (c) Only sites on the SEL may be considered for subsequent review as active candidates for designation. (d) Placement of a site on the SEL, or selection of a site from the SEL as an active candidate for designation as provided for in Sec. 922.21, by itself shall not subject the site to any regulatory control under the Act. Such controls may only be imposed after designation.
