(a) A Tribe or Tribal organization demonstrates capacity to operate a Tribal CSE program meeting the objectives of title IV-D of the Act when its Tribal CSE plan includes procedures for maintaining records necessary for proper and efficient operation of the program, including: (1) Applications for support services; (2) Records on location of noncustodial parents; (3) Records on actions taken to establish paternity and obtain and enforce support; (4) Records on amounts and sources of support collections and the distribution of such collections; (5) Records on other costs; and [[Page 327]] (6) Statistical, fiscal, and other records necessary for reporting and accountability required by the Secretary or designee. (b) The retention and access requirements for these records are prescribed at 45 CFR 92.42.
