Sec. 403.119 Under what circumstances may the State waive the distribution requirements for Secondary School Vocational Education Program or the Postsecondary and Adult Vocational Education Programs? (a) This section applies in any fiscal or program year in which a State reserves 15 percent or less under Sec. 403.180(b)(1) for distribution under-- (1) The Secondary School Vocational Education Program; or (2) The Postsecondary and Adult Vocational Education Programs. (b) Notwithstanding the provisions and Sec. 403.112, Sec. 403.113, or Sec. 403.116, as applicable, in order to result in a more equitable distribution of funds for programs serving the highest numbers of economically disadvantaged individuals, the State may distribute the funds described in paragraph (a) of this section-- (1) On a competitive basis; or (2) Through any alternative method determined by the State.
