Unless otherwise stated, the following applies-- (a) Statements in HSACs or HSAR Notices that the content is ``upon a specified date,'' or that changes in the document are ``to be used upon receipt,'' mean that any new or revised provisions, clauses, procedures, or forms must be included in solicitations or contracts issued thereafter; and (b) Unless expressly directed by statute or regulation, if solicitations have been issued prior to the HSAC or HSAR notice receipt or publication, the new information (e.g., forms and clauses) need not be included if the Chief of the Contracting Office (COCO) determines, in writing, that including the new information would not be in the best interests of the Government.
