 Subpart D_Discrimination on the Basis of Sex in Education Programs or 

                          Activities Prohibited

 

Sec.  106.35  Access to schools operated by LEAs.



    A recipient which is a local educational agency shall not, on the 

basis of sex, exclude any person from admission to:

    (a) Any institution of vocational education operated by such 

recipient; or

    (b) Any other school or educational unit operated by such recipient, 

unless such recipient otherwise makes available to such person, pursuant 

to the same policies and criteria of admission, courses, services, and 

facilities comparable to each course, service, and facility offered in 

or through such schools.
