Sec.  60-4.8  Show cause notice.

    If an investigation or compliance review reveals that a construction 
contractor or subcontractor has violated the Executive order, any 
contract clause, specifications or the regulations in this chapter and 
if administrative enforcement is contemplated, the Director shall issue 
to the contractor or subcontractor a notice to show cause which shall 
contain the items specified in paragraphs (i) through (iv)

of 41 CFR 60-2.2(c)(1). If the contractor does not show good cause 
within 30 days, or in the alternative, fails to enter an acceptable 
conciliation agreement which includes where appropriate, make up goals 
and timetables, back pay, and seniority relief for affected class 
members, the OFCCP shall follow the procedure in 41 CFR 60-1.26(b): 
Provided, That where a conciliation agreement has been violated, no show 
cause notice is required prior to the initiation of enforcement 
proceedings.
