Sec. 319.201  General policy.





    (d) The functional management responsibilities for the Department's 

Small Business Program, (small, HUBZone, small disadvantaged, and women-

owned small business programs) are delegated to the Director of the 

Office of Small and Disadvantaged Business Utilization (OSDBU).

    (e) (1) The Department's Small Business Program shall be carried out 

by appointed small business specialists (SBS) at the OPDIV Level. 

Appointments, and termination of appointments, shall be made in writing 

by the head of the OPDIV after consultation and concurrence by the 

Director, OSDBU. The small business specialist shall be responsible 

directly to the appointing authority and shall be at an organizational 

level outside the direct acquisition chain of command, i.e., should 

report directly to the head of the OPDIV or designee. The Director, 

OSDBU will exercise functional management authority over small business 

specialists regarding the small business programs.

    (2) The head of each OPDIV shall appoint a qualified full-time small 

business specialist (SBS) in the following activities: Agency for 

Healthcare Research and Quality (AHRQ), Centers for Medicare & Medicaid 

Services (CMS), Substance Abuse and Mental Health Services 

Administration (SAMHSA), Food and Drug Administration (FDA), Health 

Resources and Services Administration (HRSA), Indian Health Service 

(IHS), National Institutes of Health (NIH), Centers for Disease Control 

and Prevention (CDCP), and Program Support Center (PSC). A SBS shall 

also be appointed for the Office of the Secretary (OS). As deemed 

necessary, additional small business specialists may be appointed in 

larger contracting activities. When the volume of contracting does not 

warrant assignment of a full-time SBS, an individual shall be appointed 

as the specialist on a part-time basis. The responsibilities of this 

assignment shall take precedence over other responsibilities.
