Sec.  1386.100  Who presides.

    (a) The presiding officer at a hearing must be the Assistant 
Secretary or

someone designated by the Assistant Secretary.
    (b) The designation of a presiding officer must be in writing. A 
copy of the designation must be served on all parties and amici curiae.
