(a) Any individual who violates Sec. 209.331(c) or Sec. 209.333(a) may be permanently disqualified from performing the safety-sensitive functions described in Sec. 209.303. Any individual who willfully violates Sec. 209.331(c) or Sec. 209.333(a) may also be assessed a civil penalty of at least $1,000 and not more than $5,000 per violation. (b) Any railroad that violates Sec. 209.331 (a) or (b) or Sec. 209.333(b) may be assessed a civil penalty of at least $5,000 and not more than $11,000 per violation.
