(a) If a request for extension of protection of an international registration to the United States is made in an international application and the request includes a declaration of a bona fide intention to use the mark in commerce as set out in Sec. 2.33(e) of this chapter, the filing date of the extension of protection to the United States is the international registration date. (b) If a request for extension of protection of an international registration to the United States is made in a subsequent designation and the request includes a declaration of a bona fide intention to use the mark in commerce as set out in Sec. 2.33(e), the filing date of the extension of protection to the United States is the date that the International Bureau records the subsequent designation.
